4.2 Information on the Website is not intended to be personalised or regulated financial advice unless it is specifically provided to you as financial advice by a Financial Adviser operating under a licensed Financial Advice Provider.

6.2 Information provided as part of an application may be collected, used and disclosed to lenders and other relevant parties for the purposes of assessing and arranging your finance application, in accordance with our Privacy Policy.

6.3 Submitting an application does not guarantee finance approval or an offer of finance. Any approval is subject to the requirements of the relevant lender.

7. INTELLECTUAL PROPERTY

7.1 We and our licensors own all intellectual property rights in the Website, including all information, text, graphics, artwork, photographs, logos, icons, videos, software and the overall look and feel of the Website.

7.2 Nothing in these Terms transfers any intellectual property rights to you.

8. DISCLAIMERS

8.1 To the maximum extent permitted by law, we do not guarantee that the Website or its content will always be complete, accurate, current, suitable, available, secure, error-free or free from viruses or other harmful interference.

8.2 We are not responsible for any third-party website or content linked to or from the Website. A link does not mean we endorse or recommend that website, its content, products or services.

8.3 You are responsible for deciding whether information on the Website is appropriate for your circumstances before relying on it.

8.4 Submitting an application does not constitute approval or an offer of finance and does not guarantee a particular lender, product, interest rate or outcome.

9.2 We are not liable for any Loss arising from your use of, inability to use, or reliance on the Website, including any interruption, error, security issue, third-party website or the submission or transmission of an online application.

9.3 Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under New Zealand law.

9.4 Where our liability cannot be excluded but may lawfully be limited, our total liability is limited to NZD $350.00

10. PRIVACY

10.1 Finance New Zealand Limited is committed to protecting your privacy and handling personal information in accordance with the Privacy Act 2020.

10.2 Our collection, use, storage and disclosure of personal information is governed by our Privacy Policy, which can be viewed at www.financenz.co.nz/privacy-policy.

10.3 By providing personal information to us, including through an online application, you acknowledge that your personal information may be collected, used, stored and disclosed in accordance with our Privacy Policy.

11. SUSPENSION AND TERMINATION

11.1 Without limiting any other rights available to us, we may suspend or terminate your access to the Website immediately if we believe you have breached these Terms or where we otherwise consider it appropriate.

11.2 On suspension or termination, you must immediately cease using the Website and must not attempt to gain further access.

12. GENERAL

12.1 If we need to contact you in relation to the Website or an application submitted through it, we may do so using the contact details you have provided or by posting a notice on the Website where appropriate.

12.2 These Terms are governed by the laws of New Zealand and any disputes relating to these Terms, the Website or an application submitted through the Website will be subject to the non-exclusive jurisdiction of the New Zealand courts.

12.3 Any waiver of a right under these Terms must be in writing.

12.4 If any provision of these Terms is found to be invalid or unenforceable, that provision will be treated as modified or removed to the extent necessary and the remaining provisions will continue in full force and effect.

12.5 These Terms constitute the entire agreement relating to your use of the Website and the submission of applications or information through the Website.
